INTRODUCTION

The WMG Foundation, headquartered in Belgrade (Stari Grad), at 8 Vlajkovićeva Street, Registration Number: 28834896, Tax ID: 114232661 (hereinafter referred to as the “WMG Foundation”), is the controller of personal data collected when visiting the WMG Foundation’s website at http://www.wmgfondacija.com/ (hereinafter referred to as the “Website”) and when submitting inquiries to the WMG Foundation via the contact form on the Website

The WMG Foundation respects your right to the protection of personal data (“personal data”), and this Privacy Policy informs you about the personal data we collect and process when you use the Website, why we collect it, how we use it, the legal basis for processing, and the manner of processing. It also outlines your rights and how you can exercise them. In cases where additional or different processing of your personal data occurs (processing other types of personal data and/or for other purposes), we will inform you, prior to initiating such processing, about the type of personal data, the purpose of processing, and the legal basis for processing in that specific instance, as well as your rights related to personal data protection. In such cases, if necessary and if required by the legal basis for processing, we will request your consent for such processing of your personal data. This Privacy Policy is an integral part of the terms and conditions of use of the Website you access. By accessing the Website and using its available services and functionalities, visitors consent to and accept that the WMG Foundation collects, processes, and uses information, i.e., personal data, as a data controller, in the manner established by this Privacy Policy.

WHAT INFORMATION WE COLLECT AND THE PURPOSE OF USE

The WMG Foundation collects the following information:

  • Through Google Analytics, anonymized and aggregated data about users transmitted by their internet browser or device (technical specifications, operating system, etc.). This may include data about the devices used by visitors to access the Website, such as information about the operating system, operating system version, device brand and type, the internet network used to access the Website, and location data in the form of IP addresses;
  • Your name and email address when you use the contact form on the Website;
  • Data you voluntarily provide to the WMG Foundation when sending inquiries, requesting information about our activities or events organized by the WMG Foundation, or attending such events/public gatherings. This also applies to submitting applications for funding from the WMG Foundation or making donations to the WMG Foundation (noting that the WMG Foundation does not process or store your debit/credit card details used for the transaction).

 

We collect and process all of the aforementioned data for the following purposes:

  • To enable browsing and use of the Website, facilitate communication with users (whether regarding feedback or other inquiries), and support the development of our Website;
  • To detect and resolve errors and technical issues related to the use of the Website, as well as to prevent or address potential misuse or breaches of rights or regulations;
  • To collect funds for achieving humanitarian and other socially beneficial goals, including soliciting donations, managing existing donations or funding provided by you, and facilitating new donations;
  • To promote WMG Foundation projects, campaigns, and activities, as well as events in which the WMG Foundation is the lead, organizer, participant, or plans to participate;
  • For profiling donors or analyzing our donor database, as well as researching potential donors to avoid reputational and other risks;
  • To prevent criminal activities and assist state authorities in identifying perpetrators of crimes or in resolving civil disputes at the request of a court or other competent authority;
  • For other legally permitted and legitimate purposes for which you have provided explicit consent.

 

Change in the Purpose of Processing Personal Data

In the event of a change to the previously defined purpose of processing the personal data of Website visitors, the WMG Foundation will notify visitors of the new purpose prior to commencing data processing. In cases where consent is the legal basis for data processing, the WMG Foundation is obliged to obtain the consent of Website visitors in advance for processing their data in accordance with the new purpose.

Use of Cookies and Similar Technologies

The Website uses cookies. By accepting the terms and conditions outlined in this Privacy Policy in the manner described below or as specified on the Website itself, you explicitly consent to the processing of your personal data in the manner and for the purposes stated in this Privacy Policy.

STORAGE, SHARING, AND TRANSFER OF DATA

Your personal data is stored on the cloud.

Your personal data may be made available to affiliates of the WMG Foundation, business/project partners, and other entities authorized for data processing, strictly for the purpose of fulfilling the processing objectives for which the personal data was collected, and in compliance with applicable regulations.

We may share, make available, and/or disclose information and personal data collected from Website visitors when there is explicit consent from the visitor—the data subject—provided through acceptance of this Privacy Policy, when there is an official request from a competent state authority, or when sharing or making personal data available is necessary to fulfil contractual obligations to visitors or enforce contractual rights concerning visitors.

We cooperate with state authorities and officials, as well as other entities responsible for law enforcement, and align our operations with the applicable legal regulations of the Republic of Serbia. Any data collected from users will be made available to state authorities, their officials, or other entities if required by applicable regulations, or to protect our property and rights, as well as the rights of third parties. Furthermore, this may be necessary to ensure public safety, the safety of individuals, or to prevent or halt activities deemed unlawful, unethical, or punishable.

The Website contains links to other websites. If you choose to visit a third-party website by clicking on a link, you will be redirected to that third-party site. Third-party websites have their own privacy policies. These third-party sites are not within our jurisdiction or control, and therefore, we are not responsible for them. SECURITY

We take the security of your information very seriously and implement administrative, physical, and electronic measures designed to protect your information from unauthorized access. Personal data is stored in databases and on servers secured by modern security technologies, with access to users’ personal data granted exclusively to trained employees.

Regarding data security, the WMG Foundation applies recognized information security standards by implementing technical and organizational protective measures based on risk assessment. This includes monitoring information collection, storage, and processing methods, testing organizational and technical security measures, and taking steps to identify and/or prevent unauthorized collection or misuse of personal data.

We will fulfil our legal obligation to notify you of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined by applicable legal regulations). This notification will be made via email or a prominent announcement on the Website as soon as possible and without undue delay, provided that it aligns with legitimate law enforcement needs or any measures necessary to determine the scope of the breach and restore the integrity of the data system. 

RIGHTS OF PERSONAL DATA SUBJECTS

A visitor to the Website, or any individual whose data is processed by the WMG Foundation, has the right to access all their personal data that has been collected and processed. They also have the right to request that all personal data stored by the WMG Foundation be delivered to them in accordance with the applicable laws of the Republic of Serbia.

In accordance with applicable legislation, data subjects have the following specific rights:

  1. Right to Information: The visitor, as the owner of personal data, has the right to be informed about whether the WMG Foundation, as the data controller, is processing their personal data and in what manner.
  2. Right to Access: The visitor has the right to access their personal data to verify whether it is being processed and whether the processing complies with the law. This right includes reviewing, reading, listening to, and taking notes on the data.
  3. Right to Rectification: The visitor has the right to request the correction of any inaccurate or incomplete personal data without undue delay. They also have the right to supplement incomplete data, including by providing an additional statement, to ensure the accuracy of such information and to guarantee proper and lawful data processing.
  4. Right to Erasure (Right to Withdraw Consent): The visitor has the right to request that the WMG Foundation delete information about them and cease processing their data. This request can be initiated by the visitor through the data deletion process as described on the Website, with any consequences specified during the deletion process. The visitor has this right when the data is no longer necessary for the purpose of processing, when they have withdrawn their consent, when they have objected to data processing, when they believe the processing was unlawful, or when the data must be deleted to comply with the WMG Foundation’s legal obligations. Exceptions to this right exist if the deletion or modification of personal data would prevent investigations, detection, or prosecution of criminal acts or impede claims in civil disputes.
  5. Right to Withdraw Consent for Data Processing: The visitor to the Website who owns personal data may withdraw their consent for data processing (hereinafter referred to as “Withdrawal”) at any time by sending an explicit Withdrawal notice in writing to the email address of the WMG Foundation specified in the “Contact” section. The Withdrawal does not affect the lawfulness of data processing conducted based on consent prior to the Withdrawal. In the event of a Withdrawal, the WMG Foundation is obligated to delete all data about the visitor that it collected prior to the Withdrawal.
  6. Right to Restrict Processing: The visitor has the right to request that the WMG Foundation restrict the processing of their data (using this right may result in the inability to continue using the Website or services provided by the WMG Foundation). The visitor can exercise this right if they dispute the accuracy of their data, consider the processing unlawful, believe the data is no longer needed by the WMG Foundation, or have objected to data processing. In such cases, the WMG Foundation may only store the data. Any further processing is permitted only with the individual’s consent, for the establishment, exercise, or defence of legal claims, or to protect the rights of others.
  7. Right to Data Portability: The visitor has the right to request the transfer of their personal data to another data controller.
  8. Right to Object to Data Processing: If the legal basis for data processing is the consent of the individual who owns the personal data being processed, that individual is entitled to object to the processing of their data at any time if they deem it justified. The WMG Foundation is obligated to cease processing the data of the individual who has submitted the objection, unless the WMG Foundation demonstrates that there are legal grounds for the processing that override the interests, rights, or freedoms of the individual, or if the processing is necessary for the establishment, exercise, or defence of legal claims.
  1. Right to Lodge a Complaint: If the visitor believes that any of their rights have been violated or that their data has been processed contrary to the law, they may file an official complaint with the Commissioner for Information of Public Importance and Personal Data Protection of the Republic of Serbia at 15 Bulevar Kralja Aleksandra, 11000 Belgrade. Filing a complaint with the Commissioner does not affect the individual’s right to pursue other administrative or judicial remedies.

 

DURATION OF PROCESSING 

The WMG Foundation will process users’ personal data (depending on the specific case, purpose, and basis for processing) as long as consent for processing exists, the contractual obligation is in effect, or there is a legitimate interest. In any case, data will not be processed for longer than five (5) years from the date the processing (collection) of the personal data began, unless a longer retention period is prescribed by law.

OUR COMPANY’S POLICY TOWARDS CHILDREN

The WMG Foundation does not knowingly or intentionally collect or process personal data of minors.

If a parent or legal guardian becomes aware that a minor under their care has provided their personal data or the personal data of a third party without consent—such as for submitting an inquiry or using the contact form option on the Website, or for any other purposes of personal data processing outlined in this Privacy Policy—they can report this to the following address: [email protected].
